EU regulation 679/2016 on personal data processing – Art. 13

 

 

Garbo S.r.l with registered office in Via Vignola 6, 20136 Milano, tax code/VAT no 06884930964, (hereafter as Data Controller) hereby informs you under art. Legislative Decree no. 196/2003 as amended by Legislative Decree no. 101/2018  (hereafter referred to as the “Privacy Code”) and art. 13 of EU Regulation no. 2016/679 (hereafter the “GDPR”) that your data will be processed by the methods and for the purposes specified below:

 

  1. Subject of processing:

This Privacy Policy concerns the management methods of the site https://www.garbo.biz/ in reference to the processing of users’ personal data. Processing of personal data refers to any operation or set of operations performed with or without the aid of automated processes and applied to personal data or sets of personal data, even if not registered in a database, such as collection, registration, organisation, structuring, conservation, processing, selection, blocking, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, limitation, erasure or destruction.

 

1.1. Type of data collected

Pursuant to EU Regulation 679/2016 on the processing of personal data when using our services, you agree that our company will collect some of your personal data. This statement is intended to tell you what data we collect, why and how we use it.

 

1.1.2. Data that we collect automatically from the website

Our website does not collect your personal data (eg name, surname, contact information, address) but the computer systems and software procedures used to operate this site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols:

  • technical data: for example, IP address, browser type, information on your computer, data relating to the current (approximate) position of the instrument you are using;

The data processing will be aimed at carrying out the activities listed below:

Your personal data will be processed in both printed and electronic and/or automated form.

The Controller will keep the personal data acquired to allow browsing on the site until the end of the connection session, as well as for the time necessary to fulfill the obligations of law and / or possibly to assert and / or defend a right.

Your data may be made accessible for the purposes described in art. 2.:

  • to the Data Controller’s employees and collaborators, as persons in charge of the processing and/or internal data processors and/or system administrators;
  • to third-party companies or other parties providing services outsourced by the Data Controller (such as, by way of example, ICT companies, internet site providers, etc) in their capacity as external data processors.

 

  1. Communication of the data

With no need for express consent (under 6, letters b) and c) of the GDPR), the Data Controller may communicate your data for the purposes specified in section 2 to supervisory bodies, judicial authorities, and to those parties to whom the data must obligatorily be provided by law for the specified purposes. These parties will process the data as independent data controllers. Your date will not be disseminated.

 

  1. Data transfer

Your personal data will be stored on a server located in the European Union. It is in any case understood that the Data Controller may, if it should become necessary, have the option of moving servers outside the European Union. In this case, the Data Controller hereby guarantees that transfer of the data outside of the European Union will take place in compliance with the applicable provisions of the law, following stipulation of the standard contractual clauses required by the European Commission.

The data collected by the site during its operation are kept for the time strictly necessary to carry out the specified activities.   • the right to be informed: a) of the source of the personal data; b) of the purposes and methods of the processing; c) of the logic applied to the processing, if the latter is carried out with the help of electronic means; d) of the identification data concerning the data controller, data processors and the representative designated as per section 3, paragraph 1 of the GDPR; e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing;
  • the right to obtain: a) updating, rectification or, where interested therein, integration of the data; b) erasure, anonymisation or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected;
  • the right to object, in whole or in part: a) on legitimate grounds, to the processing of personal data concerning you, even though they are relevant to the purpose of the collection;

Where applicable, the data subject shall also have the rights guaranteed under sections 16-21 of the GDPR (right to correction, right to be forgotten, right to limitation of processing, right to data portability, right objection), and the right to present a complaint to the competent authority, the Autorità Garante.

IVA  06884930964 (in seguito, “Titolare”), in qualità di titolare del trattamento La informa ai sensi del D.Lgs. 196/2003 come novellato dal D.lgs. 101/2018 (in seguito, “Codice Privacy”) e dell’art. 13 Regolamento UE n. 2016/679 (in seguito, “GDPR”) che i Suoi dati saranno trattati con le modalità e per le finalità seguenti:

 

  1. Oggetto del Trattamento:

Tale Privacy Policy concerne le modalità di gestione del sito  https://www.garbo.biz/ in riferimento al trattamento dei dati personali degli utenti. Ai sensi del Regolamento UE 679/2016 sul trattamento dei dati personali quando usa i nostri servizi, accetta che la nostra azienda raccolga alcuni suoi dati personali. Questa informativa ha lo scopo di dirle quali dati raccogliamo, perché e come li usiamo.

 

1.1.2. Dati che raccogliamo automaticamente dal sito internet

Il nostro sito internet non raccoglie generalmente dati personali tuttavia i sistemi informatici e le procedure software preposte al funzionamento di questo sito acquisiscono, nel corso del loro normale esercizio, alcuni dati personali la cui trasmissione è implicita nell’uso dei protocolli di comunicazione di Internet.

Il trattamento dei dati sarà finalizzato allo svolgimento delle attività di seguito elencate:

1) i dati personali sono raccolti sul nostro sito al fine di:

  • consentire all’utente l’accesso al sito https://www.garbo.biz/
  • raccogliere informazioni statistiche sull’uso del sito (pagine più visitate, numero di visitatori per fascia oraria o giornaliera, aree geografiche di provenienza, ecc.) e migliorarne la fruibilità per i propri utenti.

Il trattamento dei Suoi dati personali è realizzato per mezzo delle operazioni indicate all’art. 4 n. 2) GDPR e precisamente: raccolta, registrazione, organizzazione, conservazione, consultazione, elaborazione, modificazione, selezione, estrazione, raffronto, utilizzo, interconnessione, blocco, comunicazione, cancellazione e distruzione dei dati. I Suoi dati personali sono sottoposti a trattamento sia cartaceo che elettronico e/o automatizzato.

Il Titolare conserverà i dati personali acquisiti per consentire la navigazione sul sito sino al termine della sessione di connessione, oltre che per il tempo necessario ad adempiere gli obblighi di legge e/o eventualmente per far valere e/o difendere un diritto.

I Suoi dati potranno essere resi accessibili per le finalità di cui all’art. 2. a:

  • dipendenti e collaboratori del Titolare nella loro qualità di autorizzati e/o responsabili interni del trattamento e/o amministratori di sistema;
  • a società terze o altri soggetti (a titolo indicativo società ICT, provider sito internet, etc.) che svolgono attività in outsourcing per conto del Titolare, nella loro qualità di responsabili esterni del trattamento

 

  1. Comunicazione dei dati

Senza la necessità di un espresso consenso (art. 6 lett. b) e c) GDPR), il Titolare potrà comunicare i Suoi dati per le finalità di cui all’art. 2 a Organismi di vigilanza o Autorità giudiziarie, nonché a quei soggetti ai quali la comunicazione sia obbligatoria per legge per l’espletamento delle finalità dette. Detti soggetti tratteranno i dati nella loro qualità di autonomi titolari del trattamento.

I Suoi dati non saranno diffusi.

 

  1. Trasferimento dati

I dati personali sono conservati su server ubicati all’esterno dell’Unione Europea. Resta in ogni caso inteso che il Titolare, ove si rendesse necessario, avrà facoltà di spostare i server anche extra-UE. In tal caso, il Titolare assicura sin d’ora che il trasferimento dei dati extra-UE avverrà in conformità alle disposizioni di legge applicabili, previa stipula delle clausole contrattuali standard previste dalla Commissione Europea.

  1. Periodo di conservazione dei dati

I dati raccolti dal sito durante il suo funzionamento sono conservati per il tempo strettamente necessario a svolgere le attività precisate. Alla scadenza i dati saranno cancellati o anonimizzati, a meno che non sussistano ulteriori finalità per la conservazione degli stessi, ad esempio per motivi di sicurezza nel caso in cui si debbano chiarire eventuali casi di abuso. In tali ipotesi il Titolare conserverà i dati personali acquisiti per il tempo necessario ad adempiere gli obblighi di legge e/o eventualmente per far valere e/o difendere un diritto nelle sedi opportune.

 

  1. Diritti dell’Interessato

Nella Sua qualità di interessato, ha i diritti di cui all’art. 15 GDPR e precisamente i diritti di:

  • ottenere la conferma dell’esistenza o meno di dati personali che La riguardano, anche se non ancora registrati, e la loro comunicazione in forma intelligibile;
  • ottenere l’indicazione: a) dell’origine dei dati personali; b) delle finalità e modalità del trattamento; c) della logica applicata in caso di trattamento effettuato con l’ausilio di strumenti elettronici; d) degli estremi identificativi del titolare, dei responsabili e del rappresentante designato ai sensi dell’art. 5, comma 2 Codice Privacy e art. 3, comma 1, GDPR; e) dei soggetti o delle categorie di soggetti ai quali i dati personali possono essere comunicati o che possono venirne a conoscenza in qualità di rappresentante designato nel territorio dello Stato, di responsabili o incaricati;
  • ottenere: a) l’aggiornamento, la rettificazione ovvero, quando vi ha interesse, l’integrazione dei dati; b) la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge, compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati; c) l’attestazione che le operazioni di cui alle lettere a) e b) sono state portate a conoscenza, anche per quanto riguarda il loro contenuto, di coloro ai quali i dati sono stati comunicati o diffusi, eccettuato il caso in cui tale adempimento si rivela impossibile o comporta un impiego di mezzi manifestamente sproporzionato rispetto al diritto tutelato;

Ove applicabili, ha altresì i diritti di cui agli artt. 16-21 GDPR (Diritto di rettifica, diritto all’oblio, diritto di limitazione di trattamento, diritto alla portabilità dei dati, diritto di opposizione), nonché il diritto di reclamo all’Autorità Garante.
